RE: The tariff classification of shark cartilage powder and shark liver oil from Australia.

Dear Mr. Christopher:

In your letter, dated September 11, 1995, you requested a tariff classification ruling. The products are described thus:

1. shark cartilage powder - an off-white powder for human consumption as a food supplement; will be sold to manufacturers of tablets and capsules. The U.S. Customs Laboratory has determined that the submitted sample contains 50.1 percent protein, 32.2 percent inorganic materials, and 6.5 percent moisture.

2. shark liver oil - for human consumption as a food supplement. The applicable subheading for the shark catilage powder will be 0305.59.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for fish, dried, salted or in brine; smoked fish, whether or not cooked before or during the smoking process; flours, meals and pellets of fish, fit for human consumption, dried fish, whether or not salted but not smoked, other, shark fins. The rate of duty will be 0.3 cents per kilogram.

The applicable subheading for the shark liver oil will be 1504.10.4000, HTS, which provides for fats and oils and their fractions, of fish or marine mammals, whether or not refined, but not chemically modified, fish-liver oils and their fractions, other. The rate of duty will be 2.5 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
